Don Herzog has more on the battle brewing between Catholic theocrats and the Socialist government in Spain over gay marriage. Not pretty. We’ll have to see how the measure survives widescale civil disobedience.
Mr. Herzog’s argument is odd in its expectation that Spain would have any American tradition of separation of church and state (his “worry that the Church has just exceeded its own rightful sphere of authority” - isn’t that rightful sphere of authority the question for a country that hasn’t been a representational democracy for all that long?). But the Church clearly is imposing on the reach of the state and may put issues of separation on the table.
